FedEx Home Delivery Applies for HOS Exemption

UPDATED 8/24/06: FedEx withdrew its HOS exemption application as of 8/16/06.  DoT posted FedEx's letter on 8/23/06.  Drivers should continue to submit comments on HOS violations.  We will keep updating our Resource page.  END UPDATE  

The FedEx Home Delivery application (linked in the text box) to the Dept. of Transportation for an hours of service exemption should be read by every driver.  The Federal Register announcement is also worth reading to understand the government response so far. There are a number of implications for the FedEx Home Delivery driver.  There are implications as to the "contractor" model at FedEx Ground and Home Delivery.  And there is the weird statement from the letter:

We currently would like to pursue an hours of service exemption in our Home Delivery operation which would allow our drivers to consider the time from the drivers' last delivery to their home (normal work reporting location) as off duty as the drivers are using the commercial motor vehicle as a personal conveyance during that time. [Emphasis added]
