Teamsters Local 177 and FedEx Ground
This case stems from a petition for election before the National Labor Relations Board filed by Teamsters Local Union 177 at a FedEx Ground facility in Fairfield, NJ in 2004. FedEx Ground protested that the drivers were not elegible as they were "independent contractors" and not employees. The NLRB Region 22 ruled that the drivers were employees and not "contractors" as claimed by FedEx Ground. Local Union 177 filed a number of unfair labor practices charges with the NLRB alleging election interference. The drivers voted not to unionize at the facility in 2005.
